Terms of Service

Last updated: 6 October 2026

1. Who we are

These terms apply to services provided by iMarttrends (Pty) Ltd trading as iMartCloud (registration 2017/516771/07), Bloukrans Building, Lynnwood Rd, Lynnwood, Pretoria, Gauteng, 0081 (“iMartCloud”, “we”). By ordering a service you agree to these terms.

2. Services

We provide web hosting, domain registration and renewal, SEO plans, website design projects, website maintenance plans and once-off web tasks. All services are provided directly by iMartCloud. The specification of each plan is shown on its order page.

3. Accounts

You must give accurate contact and billing details when you open a client account, and keep them up to date. You are responsible for keeping your login details secure.

4. Billing and payment

Hosting, domains, SEO plans and website maintenance plans are recurring services billed in advance. Hosting and maintenance plans are billed monthly or annually, SEO plans monthly and domains annually. An invoice is issued before each renewal date. Website design projects are billed 50% as a deposit before work starts and 50% on completion. Once-off web tasks are billed as stated in the quote. Payments are processed through Payfast. All prices are in South African Rand.

5. Late payment

If an invoice is unpaid after its due date, the related service may be suspended until payment is received. Domains that are not renewed before their expiry date may be lost and may cost more to recover.

6. Cancellation

Hosting may be cancelled at any time from the client area and remains active until the end of the paid period. Website maintenance plans run to the end of the paid month. SEO plans require 30 days written notice. Cancellation stops future invoices. See our Refund Policy for what happens to amounts already paid.

7. Acceptable use

You may not use our services for illegal content, spam, phishing, malware, or anything that harms our servers or other clients. We may suspend a service that breaches this clause, and will tell you why.

8. Your content and backups

You own the content on your website. You are responsible for keeping your own copy of it, even where we also take backups.

9. Liability

Our liability for any claim is limited to the amount you paid for the affected service in the three months before the claim. We are not liable for indirect losses such as lost profit or lost data.

10. Changes and governing law

We may update these terms and will give notice of material changes by email. These terms are governed by the laws of the Republic of South Africa.
